By accepting a quote issued by E.M. Fredericks & J.A. Fredericks T/A Jim’s Mowing – Deception Bay West (“we”, “us”), the Client (“you”) agrees to the following Terms and Conditions.

1. Agreement & Scope These Terms apply to all services provided by us, including one-off services and ongoing service plans.

Any specific details outlined in an approved quote (including pricing, billing structure, service frequency, and scope) form part of this Agreement and take precedence to the extent of any inconsistency.

2. Service Delivery & Standards

All services are performed with reasonable care, skill, and diligence in accordance with accepted horticultural and grounds-maintenance practices.

Service outcomes may be affected by factors beyond our control, including weather, soil conditions, irrigation, seasonal growth patterns, existing site conditions, and prior maintenance practices. Such variations do not constitute a service failure. Any concerns regarding a completed service must be reported within 48 hours of service completion.

We will review the matter and, where appropriate, determine a reasonable course of action at our discretion.

3. Scheduling, Access & Site Conditions

3.1 Scheduling

Service dates are scheduled based on routing, weather conditions, and operational requirements.

Exact arrival times are not guaranteed. Where weather or site conditions prevent a safe or quality service, services may be postponed and rescheduled to the next suitable date.

3.2 Client Responsibilities

The Client must ensure that, at the time of service:

• Safe and unobstructed access to all work areas is available

• Pets are secured

• hazards and obstacles are removed

• Work areas are reasonably safe for personnel and equipment

The Client must disclose any known or concealed risks, including irrigation systems, wiring, underground services, unstable ground, or hazardous materials.

3.3 Failed Access & Unsafe Conditions

If a service cannot proceed due to lack of access, unsecured pets, unsafe or non-compliant site conditions, undisclosed hazards, or short-notice client changes, the visit may be deemed a failed service.

Where a service is deemed a failed service, the visit may be forfeited and the applicable service fee may still be charged.

Rescheduling may be attempted at our discretion but is not guaranteed.

3.4 Site Limitations

We do not move heavy, fixed, or obstructive items.

Areas that are inaccessible, obstructed, or unsafe at the time of service are excluded from the service and charged as normal.

4. Pricing, Billing & Payment Terms

4.1 Pricing

All pricing is as set out in the approved quote. Pricing may be structured as a fixed monthly amount, per-service fee, or project fee, as specified in the quote.

For ongoing service plans, pricing is calculated based on the annual cost of service and billed evenly across the applicable billing periods, regardless of seasonal service frequency.

4.2 Quotes

Quotes are valid for 7 days unless otherwise stated.

Acceptance of a quote constitutes acceptance of the pricing, billing structure, and scope outlined.

Any additional work or scope changes may be quoted and invoiced separately.

4.3 Payment Terms

Invoices are issued electronically unless otherwise agreed.

Unless stated otherwise in the quote:

• Domestic clients — payment due within 3 days

• Commercial, NDIS, or DVA clients — payment due within 30 days

For ongoing service plans, invoices may be issued monthly on a post-paid or pre-paid basis as selected by the Client.

4.4 Pricing Adjustments

We reserve the right to adjust pricing: annually from 1 July in line with CPI or operating cost changes where service scope, access, or site conditions materially change and immediately where NDIS or DVA funding rules or rates change.

Where practicable, notice of pricing adjustments will be provided in advance.

5. Ongoing Services & Cancellations

5.1 Ongoing Services

Where services are provided on an ongoing basis, services continue until cancelled in accordance with this clause.

5.2 Billing Periods Ongoing services are billed by billing period (typically monthly), as specified in the quote. The applicable fee secures service availability for that billing period, regardless of the number or timing of visits.

Service frequency may vary seasonally or operationally.

5.3 Client-Initiated Cancellation

To cancel an ongoing service, written notice must be received at least two (2) full business days prior to the commencement of the next billing period.

Cancellations received after this time take effect from the following billing period.

5.4 Mid-Period Cancellations

Where an ongoing service is cancelled after a billing period has commenced: prepaid amounts are non-refundable; and post-paid amounts for that billing period remain payable in full.

5.5 Missed or Cancelled Visits

If a scheduled visit cannot proceed due to short-notice cancellation, client request, failed access, unsecured pets, or unsafe site conditions, the visit may be forfeited.

We may attempt to reschedule where operationally feasible; however, rescheduling is not guaranteed and forfeited visits do not give rise to refunds or credits.

5.6 NDIS & DVA Services

Where services are provided on a per-service basis (including NDIS or DVA funded services), a cancellation includes late notice, failed access, or unsafe or non-compliant site conditions.

In such cases, the full service fee may be charged in accordance with applicable funding rules.

The Client remains personally liable for all amounts owing where funding is declined, delayed, reduced, or unpaid.

6. One-Off Services, Deposits & Prepayments

6.1 One-Off Services For one-off or project services, scope, pricing, and payment terms are as set out in the approved quote.

6.2 Deposits Unless otherwise stated:

Services valued at $500 or more require a 50% deposit prior to commencement

Deposits secure booking availability and are non-refundable, except where we are unable to perform the service due solely to reasons within our control.

6.3 Prepayments & Credits

Prepayments represent payment for services, not refundable funds.

Where services cannot proceed due to reasons within the Client’s control, prepaid amounts may be forfeited.

At our discretion, prepaid amounts may be issued as service credits, which:

• Are not redeemable for cash

• Are not transferable without written agreement

• Must be used within 6 months

7. Late Payments, Fees & Recovery

Invoices must be paid by the due date. Where payment is overdue, we may apply reasonable late fees and suspend services.

Suspension does not pause billing unless agreed in writing.

Costs of Recovery - The debtor/s shall pay for all costs actually incurred by Jim's Mowing Deception Bay West in the recovery of any monies owed under this Agreement. You agree to be liable for and indemnify* E.M & J.A Fredericks*. These costs include recovery agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis, debt collection commission and legal fees on an indemnity basis.

8. Stored Card Authority

Where a Client has previously paid by card, the Client authorises us to securely store a payment token with our payment provider.

If an invoice remains unpaid after the due date, we may charge the outstanding balance (including applicable fees) to the stored payment method.

Card data is stored in accordance with PCI-DSS standards. We do not store or access full card details.

9. Damage, Liability & Insurance

We hold $20 million public liability insurance. To the extent permitted by law, our liability is limited to re-performing the affected service or refunding the value of that service.

We are not liable for indirect or consequential loss, concealed hazards, pre-existing damage, irrigation or underground services not disclosed, weather impacts, or normal wear and tear.

Damage claims must be reported within 48 hours of service completion.

10. Photography & Records

We may take photos or videos before, during, or after services for records, compliance, dispute resolution, training, and marketing purposes.

No personally identifiable information will be published without consent.

11. Privacy & Data Handling

Personal information is handled in accordance with the Privacy Act 1988 (Cth). Information may be stored or processed using systems including Jobber, Xero, Stripe, and Jim’s Group platforms, solely for service delivery, billing, communication, and compliance.

12. Termination

Either party may terminate this Agreement by written notice in accordance with these Terms and the approved quote.

We may terminate immediately for non-payment, repeated access failures, unsafe conditions, abusive behaviour, or where the service becomes impractical.

Termination does not affect accrued rights or amounts owing.

13. Force Majeure

We are not liable for delays or failure to perform caused by events beyond our reasonable control, including severe weather, natural disasters, government restrictions, or supply disruptions.

Affected services will be rescheduled where possible.

14. Governing Law & General Provisions

This Agreement is governed by the laws of Queensland, Australia.

If any provision is invalid or unenforceable, the remaining provisions remain in effect.

Digital acceptance and electronic communications are deemed valid and received when sent to the Client’s last provided contact details.
