Terms and Conditions of Service

1. Agreement & Acceptance

By accepting a quote, booking a service, requesting work, approving work in writing, or allowing a service to proceed after these terms have been provided or made available, you agree to these Terms and Conditions.

These terms apply to all services we provide.

Your approved quote or written service agreement sets out the specific work, price, service area and service details. If there is any difference between the quote and these terms, the quote applies to that specific service.

2. Key Terms

In these terms, “we”, “us” and “our” means E.M. Fredericks & J.A. Fredericks T/A Jim’s Mowing – Deception Bay West.

“You” and “your” means the person, business, property owner, representative, agency, provider, plan manager, or other party who requests, approves, receives, manages, or pays for the service.

“Approved quote” means the quote, service agreement, email, text message, or other written approval accepted by us.

“Service” means the work specifically included in the approved quote.

3. Quotes, Scope & Service Areas

All services are limited to the work and service areas included in the approved quote. Any extra work, changed scope, or additional areas must be agreed in writing before they are included.

Requests made on the day of service may be declined, quoted separately, or completed only if time, safety, equipment, scheduling and access allow.

Where a quote is based on photos, videos, descriptions, online information, or information supplied by you, the quote depends on that information being accurate and complete. If the actual site, access, growth, waste, hazards, size, or required work is materially different, we may revise the price, reduce the scope, provide a new quote, or decline part or all of the service.

You are responsible for making sure you have authority to request the service for all areas included in the quote. We may refuse to work in any area where ownership, access, safety, authority, or scope is unclear.

4. Service Delivery & Standards

We will perform services with reasonable care, skill and diligence.

Service results may be affected by weather, site conditions, access, obstructions, excessive growth, lawn or garden health, prior maintenance, and other factors outside our control. Where these factors affect the finish, timing, or completion of a service, this does not automatically mean the service has failed.

Any concern with completed work or visible property damage must be reported in writing within 48 hours of service completion, with photos where possible, so we can inspect and assess the matter promptly.

Nothing in these terms limits any rights that cannot lawfully be excluded.

5. Pricing, Billing & GST

Pricing and billing are set out in the approved quote.

Unless stated otherwise, quote line items are GST exclusive, with GST added after the subtotal where applicable. If a price is stated as GST-inclusive, that price includes GST.

For per-service billing, you are charged for each completed service and for any attempted or failed service that is chargeable under these terms.

For fixed monthly billing, you pay the agreed monthly amount for the billing period, regardless of the exact number, timing, or spacing of visits within that period, unless the approved quote states otherwise.

Unless stated otherwise in the approved quote, residential invoices are due within three days of issue, and commercial, agency, NDIS, DVA, aged-care, plan-managed, self-managed and third-party-funded invoices are due within 30 days of issue.

We may suspend services while invoices remain overdue. Suspension does not remove your obligation to pay any overdue amounts, late fees, or recovery costs.

We may adjust pricing where reasonably required due to changes in operating costs, site conditions, service scope, service frequency, access requirements, excessive growth, material costs, disposal costs, or funding, agency, compliance, or regulatory requirements. Where practical, we will provide notice before pricing changes take effect.

6. Late Payment, Recovery Costs & Stored Card Authority

If an invoice is not paid by the due date, we may apply a late payment administration fee as follows:

Invoice Total → Late Payment Administration Fee

Up to $250 → $25 Late Payment Administration Fee

$251–$1,000 → $50 Late Payment Administration Fee

$1,001–$2,500 → $75 Late Payment Administration Fee

Over $2,500 → $100 Late Payment Administration Fee

You are responsible for any reasonable costs we incur in recovering overdue amounts, including debt collection, recovery, legal, court, enforcement and administration costs, where permitted by law.

Where you provide card details or pay by card, you authorise us to securely store a payment token with our payment provider. We do not store or access your full card details.

If an invoice remains unpaid after the due date, you authorise us to charge the outstanding balance, including any applicable late payment fees and recovery costs, to the stored payment method where permitted by law.

7. Scheduling, Access & Client Responsibilities

Service dates are scheduled around routing, weather, workload, staff, equipment, access and operational requirements. Unless agreed in writing, we do not guarantee exact arrival times, appointment windows, or ETAs.

Where a service is scheduled for a particular day, the property must be accessible, safe and ready for service for the full scheduled service day.

Before each service, you must ensure all service areas are safely accessible and reasonably prepared. This includes unlocking gates, providing correct access details, securing pets, removing pet waste, clearing loose items or obstructions, making green waste bins accessible where required, and notifying any tenants, occupants, carers, support workers, property managers, or other relevant people.

You must tell us about any known or hidden risks before the service, including irrigation, wiring, underground services, unstable ground, hazardous materials, broken glass, sharp objects, aggressive animals, asbestos or suspected asbestos, and any other safety hazards.

Where the property is occupied, managed, leased, under construction, or controlled by someone else, you remain responsible for making sure safe and timely access is provided.

8. Failed Access, Unsafe Sites, Obstructions & Exclusions

If a service cannot be completed in full or in part due to something within your control, including lack of access, locked gates, incorrect access details, unsecured pets, unsafe conditions, undisclosed hazards, excessive obstructions, pet waste, or failure to prepare the site, the visit may be treated as a failed service and the full service fee may still be charged.

Where only part of the property is accessible or safe, we may complete the accessible areas, skip affected areas, work around obstructions, partially complete the service, or treat the visit as a failed service. The full service fee may still be charged.

We are not required to move heavy, unsafe, fixed, fragile, obstructive, or unreasonable items. Areas blocked by vehicles, trailers, furniture, toys, tools, equipment, hoses, bins, trampolines, pet waste, stored materials, or other items may be skipped and charged as normal.

Unless included in the approved quote, services do not include removing, moving, loading, or disposing of hard rubbish, building materials, rubble, soil, rocks, gravel, concrete, contaminated waste, animal waste, asbestos or suspected asbestos, or other non-green-waste material.

We may refuse to mow, whipper-snip, edge, spray, trim, or work in any area where we reasonably believe there is a risk of injury, property damage, equipment damage, glass breakage, stone throw, debris impact, or unsafe conditions.

You must tell us about any hidden or known items that may be damaged during service, including irrigation, pipes, wiring, cables, garden lighting, edging, mesh, stakes, rocks, pegs, hoses, sprinkler heads, fragile items, or concealed objects. We are not liable for damage to items that are hidden, concealed, poorly installed, unsecured, not reasonably visible, or not disclosed before service.

9. Ongoing Maintenance, Frequency & Skipped Services

Ongoing maintenance services are scheduled at the frequency set out in the approved quote. The purpose of regular maintenance is to keep the property maintained consistently over time.

Service frequency may vary seasonally or as stated in the approved quote.

You may not repeatedly skip, defer, or cancel scheduled services without our agreement. Repeated skipped services, failed access, deferred visits, or cancellations may result in revised pricing, loss of regular scheduling priority, cancellation of the ongoing service arrangement, or the property being re-quoted before further service.

10. Cancellations, Skipped Visits & Rescheduling

You must provide at least two full business days’ written notice to cancel, skip, or reschedule a service. This excludes the day notice is given, the service day, weekends and Queensland public holidays.

If less than two full business days’ notice is provided, a late cancellation or rescheduling fee of 50% of the scheduled service price may apply.

Rescheduling is subject to routing, weather, workload, access, staff availability and operational requirements, and is not guaranteed.

If a skipped, cancelled, or failed service causes extra growth, heavier clippings, additional edging, additional trimming, or extra labour at the next service, the next service may be charged at a higher price.

For ongoing services, cancellation of the service arrangement must be provided in writing before the required notice period.

For one-off or project work, deposits and job-specific costs may remain payable if you cancel, delay, change your mind, fail to provide access, or otherwise prevent the service from proceeding.

Where funding, provider, NDIS, DVA, aged-care, Support at Home, or agency rules require different cancellation terms, those rules apply to the extent required.

11. Deposits, Materials & Job-Specific Costs

Unless stated otherwise in the approved quote, services valued at $500 or more require a 50% deposit before booking or commencement.

We may also require upfront payment for materials, equipment hire, subcontractors, disposal, turf, plants, soil, mulch, fertiliser, irrigation supplies, or other job-specific costs.

Deposits and job-specific costs may be non-refundable if you cancel, delay, change your mind, fail to provide access, or otherwise prevent the service from proceeding, except where required by law or where we are unable to perform the service due solely to reasons within our control.

Once materials, products, equipment, disposal, subcontractors, or other job-specific costs have been ordered, purchased, booked, collected, allocated, or committed to your job, you are responsible for those costs even if the service is cancelled, delayed, or changed.

12. Grass Clippings & Green Waste

Grass catching, clipping collection, green waste removal and disposal are only included where stated in the approved quote.

Unless collection or removal is included, grass clippings may be mulched, side-discharged, or left on the lawn or garden areas at our discretion.

Where a green waste bin is available, you authorise us to use it for lawn clippings, prunings and green waste from the service. You must ensure the bin is accessible, not contaminated and has enough available space.

If the green waste bin is full, unavailable, contaminated, inaccessible, or does not have enough space, excess green waste may be left neatly on site or removed for an additional quoted fee.

Where grass catching or clipping collection is included, it depends on suitable lawn and site conditions. If the lawn is wet, saturated, excessively long, heavily clumped, or otherwise unsuitable, we may be unable to catch or collect clippings during that service.

13. Chemicals, Herbicides, Fertilisers & Lawn Treatments

Herbicides, fertilisers, weed treatments, pest treatments and lawn-care products are only included where stated in the approved quote or agreed in writing.

After products are applied, you are responsible for keeping children, pets, livestock and other people away from treated areas until the product has dried, or for any longer period stated on the product label or advised by us.

Weed treatment results may take several weeks and depend on the product used, weed type, weather, watering, season and site conditions.

Fertiliser and lawn-treatment results depend on factors outside our control, including watering, soil health, irrigation, weather, mowing frequency, lawn type, pests, disease and prior maintenance. Where watering-in is required, this is your responsibility unless included in the approved quote.

Where weeds are growing close to lawns, garden beds, trees, shrubs, or other desirable plants, there is a risk of non-target damage. We are not liable for non-target damage where products are applied reasonably and in line with the agreed scope.

14. Weather, Wet Ground & Service Limitations

We may postpone, stop, reschedule, or partially complete a service where weather, site conditions, or safety risks prevent the work from being completed safely, efficiently, or to an acceptable standard.

This includes rain, wet or saturated ground, soft soil, excessive heat, storms, lightning, unsafe wind, flooding, slippery surfaces, unsafe access, or any condition that may create a safety risk, damage the property, cause mower marks, or result in a poor finish.

Where a service is postponed or rescheduled due to weather or site conditions, this is not a service failure and does not entitle you to a refund, credit, or discount, except where required by law.

Lawns and garden areas may be affected by wet ground, drought stress, heat stress, disease, pests, poor drainage, uneven ground, excessive growth, prior maintenance, or existing site conditions. Where work proceeds in affected conditions, the finish may be reduced and reasonable marks, wheel tracks, mower impressions, scalping, uneven cutting, clumping, or other visual impacts may occur.

We may refuse to proceed with any service, or part of a service, where we reasonably believe it may create a risk of damage, poor results, or unsafe conditions.

15. Funded, Agency, Commercial & Third-Party-Paid Services

This section applies where services are arranged, approved, managed, or paid for by a third party, including NDIS, DVA, aged-care, Support at Home, plan-managed, self-managed, agency-managed, property-management, body corporate, commercial, or other third-party-paid services.

You remain responsible for payment where a service has been requested, approved, authorised, or allowed to proceed and funding is declined, delayed, reduced, exhausted, rejected, disputed, unavailable, or unpaid, unless we have agreed in writing to accept payment responsibility from another party.

Before service begins, you or your representative must provide any required approval, purchase order, plan manager details, provider details, participant details, support item numbers, billing requirements, or other information needed for invoicing and payment.

If an invoice is rejected because required information was not provided before service, payment remains due and the invoice may be corrected or reissued.

Funded services are limited to the approved scope in the quote or service agreement. Extra work, extra areas, reporting, photos, service notes, or administration are not included unless requested and approved in writing.

Billing units shown on invoices are used for funding, invoicing, claiming, or administration purposes and do not guarantee exact time on site unless the approved quote clearly states otherwise.

You authorise us to communicate with nominated or authorised representatives involved in arranging, approving, managing, or paying for the service. You must tell us in writing if someone is no longer authorised.

You are responsible for ensuring sufficient funding is available before authorising services. We are not responsible for monitoring remaining funding, budget balances, plan balances, service category balances, or eligibility.

If funding rules, rates, approval processes, invoice requirements, or claimability rules change, we may update the pricing, billing structure, scope, or service terms where reasonably required.

16. Damage, Liability & Insurance

We hold $20 million public liability insurance.

You must report any visible property damage in writing within 48 hours of service completion, with photos where possible, so we can inspect and assess the matter promptly.

We are not liable for damage caused by hidden or concealed hazards, pre-existing damage, undisclosed irrigation or underground services, poor site conditions, unsecured or fragile items, normal wear and tear, weather impacts, or other factors outside our reasonable control.

Where permitted by law, our liability is limited to re-performing the affected part of the service or refunding the value of that affected part of the service.

Nothing in these terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

17. Photos, Videos, Records & Privacy

We may take photos or videos before, during, or after services for record-keeping, quality control, compliance, dispute resolution, training and marketing.

Where practical, we will avoid publishing identifying details such as faces, names, vehicle registration numbers, house numbers, or private information without consent. You may opt out of marketing use by advising us in writing.

We may rely on job notes, photos, videos, timestamps, GPS records, messages, invoices, quotes, chemical records and other business records as evidence of attendance, site condition, access issues, hazards, completed work, service limitations, communications, or disputes.

Personal information may be stored and processed using systems such as Jobber, Xero, Stripe, Jim’s Group platforms, email, SMS, cloud storage, payment processors, accounting systems and other business administration platforms for quoting, scheduling, service delivery, billing, communication, compliance, dispute resolution and business administration.

18. Client Conduct & Termination

We may suspend, decline, or terminate services immediately if you, an occupier, tenant, representative, neighbour, or anyone connected with the property acts in an abusive, threatening, aggressive, discriminatory, unsafe, unreasonable, or inappropriate way towards us or anyone involved in providing the service.

We may also suspend or terminate services for repeated late payment, failed access, short-notice cancellations, unsafe animals, unsafe site conditions, funding issues, unreasonable disputes, or where the service relationship becomes unsafe, impractical, or commercially unreasonable.

Termination does not affect any completed services, outstanding invoices, deposits, material costs, recovery costs, late fees, or other amounts already owing.

19. Delays Outside Our Control

We are not liable for delays or failure to perform a service where this is caused by events outside our reasonable control, including severe weather, illness, injury, family emergency, equipment failure, vehicle breakdown, staff unavailability, supplier delays, supply issues, government restrictions, or other unexpected events.

Where possible, affected services will be rescheduled.

20. Governing Law & General Provisions

These terms are governed by the laws of Queensland, Australia.

If any part of these terms is invalid, unlawful, or unenforceable, the remaining parts continue to apply.

Digital acceptance, email approval, SMS approval, quote acceptance and other electronic communications are valid and may be relied on.

Communications are treated as received when sent to your last provided email address, phone number, postal address, or nominated contact method.

About us
